LaFayette High teacher’s arrest hinges on law passed three years ago

Charges against a LaFayette High School teacher accused of having consensual sex with a 17-year-old female student are grounded in a state law approved by lawmakers just three years ago.

Norm Hodge, a 42-year-old social studies teacher and former girls’ basketball coach at the school, was charged Feb. 1 with two felony counts of sexual assault by an authority figure. He has resigned his job and is out of jail on $5,000 bond.

Under a law passed by legislators in 2010, an “authority figure” can be a teacher, administrator, parole officer, and hospital employee, among others.

The law says that if an authority figure has sex with someone under his or her supervision or discipline, it’s sexual assault, even if the sex is consensual and regardless of the victim’s age.

The law would not apply to a college professor who has sex with an adult student.

Georgia lawmakers passed the law, known as House Bill 571, after the state Supreme Court ruled in 2009 that a teacher, who had consensual sex with a 16-year-old, could use consent as a defense.

In that case, Chase vs. the State, 28-year-old teacher Melissa Lee Chase at Harlem High School had a sexual relationship with a female junior at the school. The student was not in any of Chase’s classes. The student’s father knew about the relationship, while the student’s mother, who was separated from the father, did not know. She reported it to authorities.

Chase and her lawyers were not allowed to use consent as a defense in her trial, and she was found guilty and sentenced to 10 years in prison.

The Georgia Supreme Court overturned the conviction, saying that consent was indeed allowed.

That prompted lawmakers to change the law.

“The legislature, in 2010, came back and specifically said that (consent) shall not be a defense,” Walker County district attorney Herbert “Buzz” Franklin said.

“I think (legislators) wanted to draw a bright line and say we’re not going to tolerate these type of relationships,” Franklin said.

If the allegations against Hodge had involved a student (age 16 or over) from a different school, there would be no legal grounds for an arrest, since Hodge would not be considered an authority figure to that student, Franklin said. (In Georgia the age of sexual consent is 16. Having sex with anyone under age 16 carries a minimum sentence of 25 years in prison.)

According to Walker County sheriff Steve Wilson, Hodge had two sexual encounters, both consensual, with the 17-year-old student in December. The encounters occurred during the holiday break on private property, not on school property, according to authorities.

The charges against Hodge carry a one- to 25-year jail sentence and/or a fine up to $100,000. If convicted, Hodge would have to register as a sex offender, Wilson said.

Hodge, who is married, is a 1989 graduate of LaFayette High School in Walker County. After college, he became an assistant basketball and football coach at LaFayette High. After that, he briefly coached middle school basketball in Murray County. Then he became the assistant girls' basketball coach at Ridgeland High School in Walker County, where he took over the coaching position in May 2003. He then returned to LaFayette High and was an assistant girls' basketball coach during the 2011-12 school year. He also coached golf that year. He was not a coach this year.

17 year old girls do not want to have sex. They want to be hugged and kissed and loved. Creepy old men convince them that is what they want or they won't love them.

I don't know what world you live in but you don't know squat about 17 year olds. When you have 15,16 and 17 year olds having babies and the dads aren't any older. I'm not saying what he did was right by no means but don't try and make it sound like she was miss innocents and he was the big bad wolf.

I don't believe Norm is some perv, might not agree with his actions nor cheating on his wife. But and adult child who has the ability to say no, also made a mistake, is she punished? Norm is a good guy like him or not, do you do things that are wrong everyday or are you perfect? He's drunken actions in Dalton "obnoxious behavior " where you guys there in the press box? They had drank at a local restaurant well before the game, and someone smelled alcohol on one not all. Thing is we all screw up, making accusations about a man's character and judging him for it plus quoting some Biblical texts at the same time seems pretentious to me.

So, Norm is a "good" guy ... other than the boozing, cussing, and chasing youg girls. You can defend him all you want, but the truth is what it is.

Lafayette, GA (WRCB) -- Three coaches were arrested for drinking, and attending a high school football game. It's a violation of state ethics, and Eyewitness News is investigating if they're still walking the hallways.

Walker County's Schools Superintendent Melissa Mathis and school board members refuse to comment about the issue. Lafayette High School coaches and teachers Michael Dunfee, Rob Neal, and Norm Hodge were arrested Friday night at Southeast Whitfield High. A police report says the men were under the influence of alcohol and using profanity in the press box, while the Lafayette Ramblers played Southeast Whitfield High.

Seriously Bonnet? When I send my children to school, I'm expecting the teachers and staff to educate and guide my children. I am NOT expecting them to seduce and have sex with them! This is a grown man that should be out looking for a grown woman, not a girl that's in high school. Comparing this to the Virgin Mary is ludicrous!

Actually, he shouldn't have been looking for a grown woman since he is MARRIED to his second wife and has children with both wives. I wonder if he would condone a 41 year old teacher sleeping with his 17 year old daughter?

The fact that this law is only two years old should throw up a flag. Georgians have got by very well without this law for generations. It is to harsh and doesn't take into account human nature and has many unintended consequences. The young woman will have this own her life for the rest of her life, the citizens, who had nothing to do with it will be punished with tens of thousands of dollars in tax costs.

We should remember that Mary the mother of Jesus was thought to be only 15 when she gave birth. State law makers often over do it. Maybe a local judge and jury can offer understanding and a more reasonable punishment to this sad situation.

Mary, the mother of Jesus was impregnated by the Creator God, and not some pervert gym teacher. I hope a jury and/or judge sees this for what it is and gives this perv hard time. He should have lost his job when he was arrested for his drunken, obnoxious behavior in 2008. Shame on anyone who thinks this is ok.

Seriously? Because we live in 100 AD.....Times have changed my friend. Its the 21st century!!! Just because the Heavenly Father used the Holy Spirit to bring the Messiah into the world has nothing at all to do with a Teacher screwing his student. Regardless of age. It is the same as a dad molesting his 5 year old. It is not okay.

GA did just pass the law but maybe they didn;t realize that we needed it so badly. Agian teachers screwing students in elementary, middle, high school or college is not okay.

He should be in jail.

I am sure the girl is going threw alot, she could be pregnant, and I bet her fellow classmates know who she is and are "doggin'" her
